1. Acceptance of Terms
By accessing or using the Children Shop Canada website ("childrenshopcanada.ca," "the Site"), operated by Children Shop Canada Ltd. ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Site.
You must be at least 16 years of age to use this Site independently. If you are under 16, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By placing an order, you confirm that you are of legal age to form a binding contract in your province or territory of residence, or that you have obtained the consent of your parent or guardian.
These Terms incorporate our Privacy Policy by reference. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
2. Service Description
Children Shop Canada is an online retail store specializing in children's clothing, toys, baby products, school supplies, nursery essentials, and related accessories. We sell products directly to consumers across Canada through our website. Product descriptions, images, and specifications are provided for informational purposes and are intended to be as accurate as possible; however, we do not warrant that product descriptions, photographs, pricing, or other content on the Site are error-free, complete, or current.
All products and services are provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any product, service, or feature of the Site at any time without prior notice or liability.
3. Children's Products — Safety Disclaimer
All products listed on our Site are selected to meet or exceed applicable Canadian safety standards, including those established by Health Canada and the Canadian Standards Association (CSA). Toys are age-graded in accordance with guidelines published by the Canadian Toy Testing Council. Notwithstanding the foregoing, parents, guardians, and caregivers remain solely responsible for supervising children's use of any product purchased through our Site. We strongly recommend reading all product labels, age recommendations, and safety warnings before allowing a child to use any product.

4. Orders, Pricing, and Payment
All prices displayed on the Site are in Canadian dollars (CAD) and do not include applicable taxes or shipping charges, which are calculated at checkout. We reserve the right to change prices at any time without notice. A price change will not affect orders that have already been confirmed.
Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, pricing errors, suspected fraud, or failure of payment authorization. If we cancel an order after payment has been processed, we will issue a full refund to the original payment method.
Payment is processed through PCI-DSS compliant third-party payment providers. We do not store credit card numbers on our servers. By submitting payment information, you represent that you are authorized to use the payment method and that the information provided is accurate.
5. Shipping and Delivery
We ship to all provinces and territories within Canada. Estimated delivery times are provided at checkout and are not guaranteed. Standard shipping typically takes 3–7 business days from our Greater Toronto Area fulfilment centre. Orders over $75 CAD qualify for free standard shipping. We are not responsible for delays caused by carriers, customs, weather events, or other circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the carrier.

6. Returns and Refunds
We offer a 30-day return window from the date of delivery for most products, provided items are unworn, unwashed, and in their original packaging with all tags attached. Certain product categories — including car seats, baby monitors, and breast pumps — may have restricted return eligibility for hygiene and safety reasons, which will be clearly noted on the relevant product pages.
Exchanges are processed free of charge. Refund returns are subject to a flat $8 CAD return shipping fee, which is deducted from the refund amount. Refunds are issued to the original payment method within 5–10 business days of our receiving the returned item.
7. Acceptable Use
You agree to use the Site only for lawful purposes and in accordance with these Terms. Without limiting the foregoing, you agree not to:
- Use any automated system, including robots, spiders, scrapers, or data mining tools, to access, scrape, or index the Site or its content without our prior written consent.
- Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site, through hacking, password mining, or any other means.
- Submit false, misleading, or fraudulent information, including fake reviews or fictitious order details.
- Upload, transmit, or distribute any malware, viruses, phishing links, spam, or any other harmful or unsolicited material.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
- Use the Site to send unsolicited commercial communications (spam) to any third party.
- Access the Site from a jurisdiction where such access is prohibited by local law or regulation, including jurisdictions subject to comprehensive sanctions by the Government of Canada.
- Interfere with or disrupt the Site's infrastructure, including by imposing an unreasonable load on our servers.
We reserve the right to terminate or restrict your access to the Site at any time, without notice, if we reasonably believe you have violated these acceptable use provisions.
8. Intellectual Property
All content on the Site — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software — is the property of Children Shop Canada Ltd. or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent, except that you may print or download one copy of a reasonable number of pages for your own personal, non-commercial use, provided you do not modify the content and you retain all copyright and other proprietary notices.
9. Third-Party Services and Links
The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Children Shop Canada Ltd. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of, or reliance on, any such content, goods, or services available on or through any such third-party websites or services.
10. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHILDREN SHOP CANADA LTD. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND UNINTERRUPTED AVAILABILITY.
We do not warrant that the Site will be secure, error-free, or that defects will be corrected. We do not warrant that the results obtained from use of the Site will be accurate or reliable. No advice or information, whether oral or written, obtained from us or through the Site shall create any warranty not expressly stated in these Terms.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHILDREN SHOP CANADA LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) ANY PRODUCT PURCHASED THROUGH THE SITE; (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
Our total aggregate liability to you for all claims arising out of or relating to the use of the Site or any product purchased through it shall not exceed the greater of (a) the total amount paid by you to Children Shop Canada Ltd. during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).
12. Indemnification
You agree to defend, indemnify, and hold harmless Children Shop Canada Ltd., its directors, officers, employees, affiliates, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable legal fees) arising from: (a) your use of and access to the Site; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (d) any claim that content you submitted caused damage to a third party.
13. Force Majeure
Children Shop Canada Ltd. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, fire, flood, earthquake, epidemic, pandemic, war, terrorism, civil unrest, government sanctions, embargoes, labour disputes, strikes, utility or telecommunications failures, internet outages, cyberattacks, cloud infrastructure failures, or disruptions in third-party carrier or supplier services.
14. International Use
The Site is operated from Canada and is intended primarily for customers within Canada. We make no representation that the Site or its content is appropriate, available, or legally permissible for use in locations outside of Canada. If you choose to access the Site from other jurisdictions, you do so at your own risk and are responsible for compliance with local laws.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the City of Toronto, Ontario, Canada, and you consent to the personal jurisdiction and venue of such courts.
If you are a consumer resident of a Canadian province with consumer protection legislation that cannot be contracted out of, these Terms do not limit or exclude any rights you may have under such legislation, and to the extent of any conflict, the consumer protection legislation shall prevail.
16. Dispute Resolution
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected] with a written description of the dispute. We will endeavour to resolve the matter within thirty (30) calendar days. If the dispute is not resolved within that period, either party may pursue formal proceedings as described in Section 15.
17. Termination
We may suspend or terminate your access to the Site at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, the limitation of liability, indemnification obligations, and governing law provisions.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, which shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
19. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Children Shop Canada Ltd. regarding your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site.
20. Assignment
Children Shop Canada Ltd. may assign or transfer these Terms, and any rights and licences granted hereunder, to a third party without restriction and without notice to you. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section shall be null and void.
21. No Waiver
The failure of Children Shop Canada Ltd. to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any term of these Terms will be effective only if in writing and signed by an authorized representative of Children Shop Canada Ltd.
22. Modifications to These Terms
We reserve the right to revise these Terms at any time. Material changes will be announced via a prominent notice on the Site at least fourteen (14) calendar days before the changes take effect. The "Last Updated" date at the top of this page will be revised accordingly. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms.
23. Electronic Communications
By using the Site or contacting us via email, you consent to receive communications from us electronically. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, consistent with applicable Canadian electronic commerce legislation.
